Inter-relationship or interaction between various central offices

1. In the Church

• Our collaboration is based on the theological and moral teachings of the Church.
• Juridically the Canon Law binds us and prevails over our Constitutions and Laws which need the approval of the Congregation for the Evangelisation of the Peoples who is the ‘authentic interpreter of our Constitutions’ (art 12). Note that we are talking of ‘Constitutions’ and not of ‘Laws’.

Corrélation ou interaction entre les différents organes centraux

1. En Église

• Notre marge de manœuvre tient compte des enseignements dogmatiques et de théologie morale de l’Église.
• Juridiquement le droit canon nous lie et prime sur nos Constitutions qui, pour entrer en vigueur, ont besoin de l’approbation de la Congrégation pour l’Évangélisation des Peuples, « véritable interprète de nos Constitutions » (art. 12). Noter ici qu’on parle de ‘Constitutions’ et non de ‘Lois’.

2. In the SMA

Administrative organs and the texts that they approve

• Constitutions are voted in the General Assembly and approved by the Congregation for hte Evangelisation of the Peoples.
• Laws are the texts of the General Assembly promulgated by the Superior General.
• Decrees, Decisions and other legislative texts (directories, protocols…etc) are published by the Superior General.
• Decisions taken by the Plenary Council.

The hierarchy of the decisions follow the hierarchy of the administrative organs.

2. Dans la SMA

• Constitutions votées en AG et approuvées par la CEP
• Lois : Textes de l’AG, promulgués par le Supérieur Général
• Décrets, Décisions et autres textes á caractère législatif (directoire, protocole, etc…) publiés par le Supérieur Général
• Décisions prises par le Conseil Plénier
